		<description><![CDATA[The fight in the CDN space continues In a mixed verdict for Limelight Networks NSDQ LLNW  the U.S. District Court in Massachusetts refused to issue a permanent injunction against it while the case is on appeal and did not give Akamai NSDQ AKAM summary judgment in the case as the bigger CDN was asking for. But Limelight also did not get its motion for a new trial or a revised judgment in the $45.5 million verdict for Akamai that was handed down earlier this year.The judge denied Akamais motion for a permanent injunction as premature Limelight said. 		<title><![CDATA[Limelight-Akamai Judge No Permanent Injunction No New Trial LLNW AKAM]]></title>
		<description><![CDATA[Mixed news for Limelight Networks LLNW in its patent war with larger rival Akamai Technologies AKAM U.S. Federal Judge Rya Zobel has denied Akamais request for a permanent injunction against Limelight which is violating an Akamai-controlled patent. Thats good news for Limelight -- a shutdown could have jeopardized about half of its business.But Judge Zobel also denied Limelights motions including a request for a new trial. The court hasnt announced a date for the resolution of Limelights other pending defenses according to a press release.In February a U.S. District Court jury ordered that Limelight pay Akamai $45.5 million for the infringement. For perspective Limelights quarterly revenues are around $30 million.Analysts expect that Limelight will announce a technology workaround during its Q2 earnings call likely in August. Will it still be around then? AT&amp;T has names Cathy Martine EVP-Content Distribution to lead AT&amp;Ts enterprise digital media efforts and this group.CND business is not necessarily new for the company it has customers like Forbes.com and AccuWeather.com but now it says it will be selling more of these services to help companies deliver digital media to consumers PCs and mobile phones...so in essence a more digital media focus. It has tied up with software companies such as ExtendMedia Qumu and Stratacache to help in packing and delivery of the content.AT&amp;T also said it will spend nearly $70 million by the end of the year to bolster its network infrastructure across the United States Europe and parts of Asia. 		<description><![CDATA[As expected AT&amp;T T is readying its expanded contentmedia delivery business for a big Q3 push. The company sent out a press release today informing the world that its spending $70 million on network and development investments by the end of the year that its signed deals with three software companies to deal with various forms of multimedia content and that its appointed Cathy Martine as EVP of its new Content Distribution unit.Whats the point? To take advantage of the fact that AT&amp;T owns one of the largest networks in the world which it can leverage to chip some of the $800 million CDN market away from the likes of Akamai Technologies AKAM Limelight Networks LLNW and a host of smaller players like Level3 LVLT. Disclosure SAI chairman Kevin Ryan is an investor in Panther Express a CDN.AT&amp;T probably wont steal any of Akamai or Limelights big customers overnight -- it lacks the CDN capacity that Akamai has and the breadth of other services like DRM and transcoding according to analyst Dan Rayburn. 		<description><![CDATA[A rare good day for Limelight Networks LLNW stock -- which closed up 15% to $4.20. Though its down 8.4% to $3.85 in after-hours trading.Why the jump? Two items relating to its patent war with archrival Akamai Technologies AKAM which Akamai has been winning.First a good note from Jefferies analyst Katherine Egbert who attended yesterdays patent hearing in Boston and published a more detailed report today than Reuters did last night. Egbert says the Federal judge seemed positively disposed towards Limelight. A permanent injunction would jeopardize about half of Limelights business.Egbert still expects Limelight to be sold for around $6-7 per share or more if it develops technology workarounds that dont infringe on Akamais patent. After a two-day 30% spike at the beginning of the month shares had gradually dropped down until today when they got a 13% bump. Why? We dont know. But we have some ideas.Limelight LLNW has a big date on Wednesday June 18 in its patent war with rival Akamai Technologies AKAM so far its a war Limelight is losing. This week Federal Judge Rya Zobel will hear arguments from both sides including Akamais motion for a permanent injunction which if granted without a stay could potentially jeopardize half of Limelights business. Also being heard Limelights request for a new trial etc. We suppose that Judge Zobel could immediately announce something this week but we wouldnt count on it and we figure that LLNW investors would be thinking the same thing.So what else has them jittery? A few possible explanations- A chat hosted by Citigroup with industry analyst Dan Rayburn where he reviewed the CDN landscape pricing and the potential opportunity for Limelight to have a work-around to Akamais patent according to a post on the Yahoo Finance message boards.- Excitement about a new Amazon AMZN video streaming service which like Amazons Unbox movie download service would presumably run on Limelights servers.- Investors deciding that Limelight is cheap at $3.10 a share. 		<description><![CDATA[Content delivery network Akamai Technologies AKAM has been hitting its numbers. Time to get out now say Goldman Sachs analyst Derek Bingham says in a note summarized by Barrons editor Eric Savitz. Bingham also cut his 2008 EPS estimates to $1.69 from $1.72 and his 2009 estimate to $2.01 from $2.06. SavitzBeyond valuation he added in a research note this morning we are also concerned about intensifying competition as private entrants proliferate and selected large network operators begin to eye the space. He contends that most of the companys 2700 customers will be able to increase pressure on Akamai as contracts come up for renewal this year.Those large network operators include Level 3 LVLT which has a growing CDN business and AT&amp;T T which is supposedly prepping its sales force for a big CDN push in Q3.Akamai shares are down 7.4% this morning to $36.36. Smaller rival Limelight Networks LLNW isnt doing much -- up 0.7% to $2.89. 		<description><![CDATA[The fate of content delivery network Limelight Networks LLNW sits in the hands of a Federal judge in Boston who will decide whether to issue a permanent injunction against Limelight for violating patents controlled by larger rival Akamai Technologies AKAM. But lets say the judge does come down hard on Limelight and essentially hamstrings a good chunk of its business. Whats the rest worth?In a note Jefferies analyst Katherine Egbert estimates that about half of Limelights business -- software downloads live streaming non-traffic-related CDN services and its International business -- doesnt infringe Akamais patent.- Egberg estimates that the clean 50% of revenue could reach $82 million in 2009... and at a 10x terminal value multiple is worth $2.92 per share.- Based on the probabilities of various cash settlement outcomes Limelight pays Akamai a lot a little etc. she estimates Limelights cash balance as $85 million at the time of the judges decision which would be worth about $1.12 per share.- And the infringing half of Limelights business? Egbert says it would have different value to different potential acquirers based on whether theyd be buying Limelight for its customer base like Akamai might for its technology like Microsoft might or for both. So she stops short of assigning a cash value to the dirty half of Limelight.Either way the clean half and Limelights cash balance add up to $4.04 per share per Egberts estimate -- 34% more than the $3.02 LLNW closed at on Tuesday. But still 83% below its 52-week-high. Yikes.The problem Its not likely that anyone would buy Limelight until the judge has ruled on the permanent injunction she notes. If Limelight gets good news its stock will pop. 		<title><![CDATA[Business Got The Blues? Blame Hollywood]]></title>
		<description><![CDATA[A favorite crutch of underperforming public companies Blame the weather. Miss your sales goals for the quarter? Thats because it was too hot or too cold. But this spring saw a new twist on an old idea Rather than blame mother nature for their woes companies are pointing the finger at Hollywood.Miraculously the networks and studios themsleves emerged from this winters writers strike largely unscathed. But retail chains restaurants and other companies -- most of them with faint relationships with Hollywood -- have all blamed the 14-week strike for their problems.Limelight Networks LLNW CEO Jeff Lunsford claimed in the companys Q4 2007 earnings call that the CDN would lose millions this year because of the writers strike. New content is what draws viewers online and theres simply less new content in the ecosystem this year because of the strike Lunsford said. But Akamai AKAM Limelights much bigger competitor says the strike had no impact on its business.Neiman Marcus Inc. The upscale clothing-store chain saw revenues for the month of February decrease 7.3 percent from the year before particularly in its California stores. The writers strike I think had an impact no question said CEO Burt Tansky. It took a great deal of money out of the economy while that strike was on.Warner Music Group WMG Warner said that publishing business saw synchronization revenue -- money made when TV shows and advertisers use WMG-owned songs drop 4.5% in Q2. WMG said sync sales were negatively impacted by the Writers Guild of America strike.Entercom Communications Corp ETM Q1 revenues for the radio broadcasting company were down due in part to weaker national advertising. 		<description><![CDATA[A helpful coincidence As we pondered this morning what was going on with AT&amp;Ts much-hyped push into the content delivery network CDN industry analyst Dan Rayburn was publishing some answers.Specifically Rayburn says AT&amp;T has spent the last several months building out its CDN infrastructure and training its sales force and resellers to sell CDN services which it expects to aggressively push into the market during Q3.Since December AT&amp;T has been busy working on the build out andexpects to spend between $70-$80 million on infrastructure this year.By the end of 2008 AT&amp;T is aiming to have 400Gbps gigabits per second of capacityonline for all their content delivery serviceswhich would increase their capacity by 4x what they have now. Whencompleted their content delivery services will be delivered from 32nodes in 7 countries and they will be Adobe ADBE Flash Certified by yearsend and will be supporting live and on-demand delivery for all themajor formats.Currently some customers of AT&amp;Ts are still having theircontent delivered via Akamai AKAM who AT&amp;T has been re-selling andusing as one of its partners for some time... 		<description><![CDATA[Five months ago AT&amp;T T told Wall Street that one of their big growth pushes for 2008 would be their content delivery business Competing with companies like Akamai Technologies AKAM and Limelight Networks LLNW to push media companies video streams large files and photo libraries across the Web.So... where is AT&amp;Ts content delivery network CDN business?From Light Readings AT&amp;T Prepares CDN Push dated Dec. 12 2007During the companys analyst day Dec. 11 2007 Ron Spears AT&amp;Ts group president of global business services said the carrier would increase its focus on businesses adjacent to its core networking capabilities including content distribution. AT&amp;T already offers streaming and caching services Spears said. But he added that AT&amp;T is now focused on rapidly expanding capacity so it can better snare customers in the content delivery network CDN space... In very short order we will have the ability and all of the asset capacity necessary to optimally deliver and host content in the needed formats with the superior quality of service that our customers demand Spears said.Rollouts like those take time. But we figured that five months in AT&amp;T should have something to show for it. So we looked around for press releases in which AT&amp;T boasted that it had signed a large media company away from the industry-leading CDN ... or something along those lines. 		<title><![CDATA[Revelation Akamai AKAM Not Completely Immune To Crappy Economy]]></title>
		<description><![CDATA[After blowing out Q4 sales and profits in February Akamai CEO Paul Sagan told us the company hasnt felt any pain from the slowing economy. But Jefferies analyst Katherine Egbert has tracked down a few data points that paint a less rosy picture for Akamai AKAM. The company is not completely immune to current macro headwinds she says in a note today.SpecificallyEgberts checks indicate that Akamai missed its Q1 booking targets. She estimates that 25% of the companys quarterly sales come from in-period activity from new or not previously committed customers.Shes heard that some large media customers may have been given rebates. Shes not sure why but supposes it could be because of the abnormally light new content season due to the Hollywood writers strike. Weve heard that before from rival Limelight Networks but were skeptical. And Akamai CFO J.D. Sherman said in late February that the company hasnt seen any huge impact from the strike.Akamais Web software application acceleration system was down for a significant amount of time during Q1. She wouldnt be surprised if customers are compensated for the problems.Enterprise customers are being cheap and arent buying add-on products as fast as anticipated. Deals appear to have slipped as customers are becoming more frugal with their budgets.Weve heard mixed results from enterprise-heavy companies this quarter. Cisco CSCO said January in particular was very challenging and hasnt issued any encouraging news since then. But Research In Motion RIMM said earlier this month that enterprise sales have been solid despite the economy.So its hard to predict where Akamai will fall. And Egbert stopped short of whacking Akamai estimates for either Q1 or 2008. 		<description><![CDATA[From the filings and stories executive salary watch for some media companies-- MSLO Martha Stewart founder of Martha Stewart Living Omnimedia NYSE MSO received $2.06 million in compensation for 2007 while company CEO Susan Lyne received a little over $1 million as the company returned to profitability reports AP citing the proxy filing. She was paid a salary of $900000 and a bonus of $495000 the same as in 2006...she also received $378000 under a non-equity incentive plan. Lyne received a salary of $900000 the same as in 2006. Wenda Harris Millard the president of media for MSLO who joined the company in June last year has a base salary of $550000. She received a bonus for 2007 of $440000 she also received a cash incentive payment of $450000 to join the company from Yahoo NSDQ YHOO portions of which amount may be forfeited if she leaves the company before the third anniversary of her employment the filing says. The company agreed to make her target bonus 80 percent of her base salary in future years. NYSE NWS all of which are much bigger companies reports LAT citing the proxy filing. In 2007 Moonves collected $5.3 million in salary and $18.5 million in cash bonuses. He also received more than $12.5 million in stock and option awards according to the proxy. his contract was renegotiated in October last year and he will now receive a lower base salary and more equity-based compensation. However that didnt kick in until October of last year. CBS NYSE CBS Chairman Sumner Redstone received total compensation of $9.7 million in 2007 including a $1.4 million salary and a $4.75 million bonus. That was down from a $12.2 million total the previous year.-- Akamai CEO Paul Sagan had a total compensation package of $4.32 million up from $4.03 million in 2006 according to the proxy filing with a base salary of $403K almost similar to last year.]]></description>

And dont expect Akamai to bail Limelight out with a last-second acquisition any time soon he says.Earlier this year a jury found Limelight guilty of infringing a patent owned by MIT licensed exclusively to Limelights larger rival Akamai. If a federal judge issues a permanent injunction against Limelight later this year its appeal could drag on for 12 to 18 months extending the patent war into 2010 Hilal said in a note.Will Akamai buy Limelight to put it out of its misery -- and pick up a bunch of high profile clients like Microsoft MSFT and Amazon AMZN on the cheap? Probably not for a while Hilal says. He thinks Akamai will wait until a judge issues the injunction against Limelight which he says could happen in Q4 of this year before making an offer. 		<description><![CDATA[The peer-to-peer industry continues to talk up the progress its making with Internet service providers which is nice. But until the P2P business can also convince content providers that it is a reliable way to distribute their goods it wont matter much.Todays press release NY-based P2P content distribution firm Pando released more stats from tests its conducting with ISPs like Verizon VZ AT&amp;T T and Comcast CMCSA. The results Using P2P is good!Specifically Pando says that when working hand-in-hand with Internet providers it can boost P2P download speeds up to 235% on U.S. cable networks and up to 898% on International networks. It also says it can make P2P traffic more efficient for ISPs which could cut down on network congestion and potentially save broadband providers some money on bandwidth.This is certainly good news -- the P2P industry should do everything it can to sweeten its shaky relationship with Internet providers. But it probably wont help them win much more business from big media. As weve said before there are still major limitations to P2P content delivery which until solved will throttle their success.Ease of use P2Ptransfers require a separate software downloadinstallation. They dontjust play video directly in the browser the way Flash video streams do. And have fun asking your ITdepartment to let you install P2P software at work.Reliability P2P relieson individuals computers to power others downloads. Thats a lot iffier than a professional server hooked up to a dedicated pipe. 		<description><![CDATA[Akamai AKAM investors are finally getting a breather Shares of the Internet content distribution firm are up 7% this morning -- trading around $30.25 -- after Piper Jaffray upgraded the stock to buy and Citigroup reissued its buy rating yesterday. Shares had tumbled 16% from Feb. 7 the day after Akamai posted stellar Q4 results until yesterdays close.Why buy Akamai? Piper analyst Aaron Kessler says in a note summarized by Barrons editor Eric Savitz that the company should have minimal impact from the slowing economy. 		<title><![CDATA[Limelight Gears Up For Patent Nuclear War]]></title>
		<description><![CDATA[Earlier this month we wrote about Akamais patent lawsuit against competitor Limelight.  Akamai had dominated the content delivery network space for many years but Limelight has made serious inroads lately putting a ton of competitive pressure on Akamai.  Akamais response to sue for patent infringement is exactly the sort of societal negative that shows how the patent system harms society.  To reinforce that it appears that rather than just further innovating Limelight is now spending money that could have and should have gone to research and development on buying up its own patent portfolio to act as a nuclear stockpile to fight off Akamai.  End result?  Lots of money wasted on patents and patent infringement lawsuits less innovation in the space and less competition. 		<title><![CDATA[Blu-ray Blues]]></title>
		<description><![CDATA[Now that HD DVD is dead and Sonys Blu-ray has apparently won the HD media war why arent we seeing Blu-ray drives available as a factory option at least for Macintosh computers?  I think Steve Jobs is deliberately holding back in a high-stakes gamble for control of HD video distribution.Apple has been a member of the Blu-ray camp practically since its inception. And remember 2005 -- Apples Year of HD when the company declared allegiance at MacWorld in the company of Sonys chairman. So where are the drives and what does Apple have to lose by providing them or not?Theres a tiny chicken-and-egg problem here in that Apples professional applications dont yet support Blu-ray. Maybe theyll use that as an excuse if a lame one. Clearly Apple has had plenty of time to make it possible to burn Blu-ray discs. As the dominant hardware and software vendor to the movie industry -- an industry EAGER to jump to Blu-ray -- it would appear to be in Apples interest to be shipping those Blu-ray drives right now. So the fact that they arent shipping has to be a conscious decision at Apple where as we know most big decisions -- conscious or not -- are made by Steve Jobs.Before we attempt to calculate whats at risk here for Apple lets think about what the company has to gain -- or what they might THINK they have to gain  by delaying. Apple clearly sees a huge part of its future in content distribution including TV shows and movies. I can only guess that Jobs sees Blu-ray as a threat to that download business and this decision to delay Blu-ray deployment is an expensive stalling action buying time for Apple to launch its own true HD alternative.Yes you can download some movies from iTunes in 720p right now but in the surging HD market 720p is no longer good enough. The obvious standard is 1080p and right now you need Blu-ray or BitTorrent to get that. Putting on my near-futurist hat then Im guessing Apple is working madly to deploy its own 1080p download solution and is hoping the world will wait for it.Jumping to 1080p is a huge challenge for iTunes. Just look at the comparative sizes of the QuickTime HD trailers for the upcoming Indiana Jones and the Kingdom of the Crystal Skull on Apples own web site. The 480p trailer thats standard definition and slightly better quality than the 640-by-480 shows most people download through iTunes now requires 47 megabytes while the 720p file is 78 megabytes and the 1080p version requires 126 megabytes. The trailer runs just under two minutes 151. The three prior Indiana Jones films were 115 118 and 126 minutes respectively so lets take the average and figure this new movie will come in right at two hours in length. Extrapolating from the size of the trailer then a good guess about the ultimate file size for the H.264 download versions of this upcoming blockbuster are 3048 megabytes 5059 megabytes and 8172 megabytes respectively.Apple faces a number of challenges offering files of this size for download the least of which is economic. Yes it will probably cost Apple four times as much to offer downloads of a 1080p version of a movie than its 640-by-480 version but the market is already expecting to pay an HD premium at least for a while so money isnt really a major factor. The real speed bumps are the sheer impact of a true volume HD service on the Internet itself and the sad fact that most Macs cant even play 1080p video. They simply arent powerful enough.Apple isnt stupid though so it makes sense that they are preparing solutions to both problems. The download impact problem will probably be solved with a new iTunes infrastructure based not on Akamai but on Google. All those new Google data centers have to be for something more than just search and I have long surmised that their real intent is video distribution through peering deals with ISPs. This will be where the Apple-Google alliance finally shows itself.Since Google is already testing their new $200 million data center near my home in South Carolina I can only guess that this capability will be available shortly.As for giving Macs enough grunt to play 1080p video I explained more than a year ago that Apple has privately committed to putting an H.264 encoderdecoder chip in its entire range of machines. That specific chip began sampling last July so Apple should be able to start shipping the new Macs any time soon certainly long before Christmas.There is a huge opportunity here for Apple taking a swipe at Blockbuster and NetFlix at the same time. There are tens of millions of new Macs to be sold too though most people will be able to participate by buying an Apple TV. Think about it. An Apple TV is cheaper than a Blu-ray player. Once youve bought the Apple TV youre committed to the system which is to say committed to NOT going with Blu-ray. This wont be the case with many techies of course but my Mom once she buys something sticks with it for a]]></description>

		<title><![CDATA[When The Competition Gets Tough Akamai Sends Out The Patent Attorneys]]></title>
		<description><![CDATA[Last summer we noted that the Content Distribution Network CDN space was getting crowded with competitors which was seriously cutting into the profits of Akamai who is considered the leader in the space.  So whats a company like Akamai to do?  Well they could spend money on continuing to innovate offering a better product and providing reasons why customers would want to buy services from them... or they could just sue their competitors for patent infringement.  It looks like Akamai is going with door number 2.  Not surprisingly since juries quite often side with patent holders a jury has ruled in favor of Akamai in a patent infringement lawsuit over a patent that some are noting appears to be rather obvious in that it describes a process for hosting online content via distributed servers.  While its not clear how obvious this patent really may be what does seem clear from multiple comments on Slashdot is that there appears to be a fair amount of prior art including an earlier patent that appears to cover similar territory.  Either way it appears that many different companies and individuals have been trying to tackle this problem in similar ways and that theres marketplace demand for products in the space. 		<title><![CDATA[Updated Akamai Prevails In Court Over Limelight $45 Million Award Limelight Shares Crushed]]></title>
		<description><![CDATA[This case has been wending its way through the courts for awhile but Akamai NSDQ AKAM has won the latest round in its longstanding patent infringement case against rival CDN Limelight NSDQ LLNW. In a statement the company said that a Boston jury found that Limelight had infringed on four of its patents and it said the company would have to pay a $45 million penalty. Akamai says it will ask the court to issue a permanent injunction on Limelights use of the patents. Limelight which has had nothing go right for it since coming public last year is off over 35 percent on the news and is now down over 80 percent from its 52-week highs. Akamai is currently up over 7 percent. Release.This may not be the end of the story of course. A Limelight spokesman says the company will appeal reports Reuters.Update Limelight waited until 534 PM ET on a Friday to offer its official response to the verdict We are disappointed with the jurys verdict in this matter.
