		<title><![CDATA[SCO Gets Wrist Slapped Over Novell Unix Copyrights]]></title>
		<description><![CDATA[More than five years after SCO went on its quixotic quest to try to sue Linux out of existence its finally had to pay at least some of the price.  As you probably know soon after SCO sued IBM Novell pointed out that it was pretty sure SCO was wrong in claiming to hold copyrights over Unix code.  In fact Novell was pretty sure that it still owned those copyrights.  SCO then took Novell to court over the issue -- making that the main arena for SCOs claims.  It took plenty of time but the judge ruled that indeed Novell owned the copyrights basically derailing SCOs entire basis for its lawsuits.  At first it appeared as if SCO was just going to give up.  It declared bankruptcy and many hoped it would just go away.  Unfortunately it received a lifeline in the form of a $100 million line of credit allowing it to keep on suing.As for the Novell case a judge has finally come down with the final ruling on a fine and its basically a slap on the wrist to SCO.  Rather than buying Novells argument that 95% of SCOs licensing revenue actually belongs to Novell the judge took a much more limited approach saying SCO only owes $2.5 million.  Its not peanuts but its a lot less than many had hoped.  It certainly will allow SCO to keep going and potentially appeal this ruling which is why many are labeling this as a mixed bag sort of ruling.  Still as has been pointed out SCO is the one that kicked this off suing IBM and then Novell... and the end result is that SCO is paying out $2.5 million. Nobody knows better than Katharine Weymouth that the newspaper industry is experiencing what may be called euphemistically a period of transition. But the new publisher of the Washington Post isnt big on euphemisms.The numbers suck in our business the 42-year-old granddaughter of legendary Post publisher Katharine Graham declares holding her tall lithe frame dancer-straight the result of a childhood spent in ballet classes. Its a lovely day in early April and Weymouth is at the Posts downtown D.C. headquarters meeting with the staff of Style one of the papers more popular sections. The session is a stop on the listening tour of the newsroom that shes been conducting since February when she was named publisher and chief executive of Washington Post Media a newly configured unit that encompasses the newspapers long-divided print and web operations. The day before the paper won six Pulitzer Prizes a record for the Post and the second-biggest haul ever for any newspaper in a single year. To celebrate Weymouth threw open the doors of her decidedly unflashy home for an impromptu shindig greeting coworkers in her bare feet and chatting with young staffers into the night. But the afterglow is already waning and now its back to the dismal reality of newspapers everywhere. We are going to have to get smaller and better and still find a way to put out the best product we can Weymouth tells the assembled reporters and editors at the headquarters of the Post. That may mean that we have to make some choices about what we can cover and what we cantand those are going to be hard choices. Her new role makes her the almost inevitable successor to her uncle Washington Post Co. chairman and chief executive Don Graham and the two can often be seen circling the Post building together walking and talking. Don a physically fit 63-year-old isnt planning to go anywhere anytime soon and in the meantime Weymouth must prove herself by running the unit that defines the Washington Posts celebrated brand but that may also have the bleakest future. The Post Co.s performance tells the story of a fading industry Over the past 24 years its cable unit has prospered but the newspaper broadcast and magazine divisions including Newsweek have become dwarfed by its Kaplan unit which offers education test-preparation and career-training services and whose cash flow today accounts for nearly half of the companys $4.1 billion annual revenue. The tail has become the dog and the Washington Post Co.forever identified with fearless reporting on the Watergate scandal and the Pentagon Papersnow defines itself as a diversified education and media company with education as the largest and fastest growing business.Weymouth is very talented very smart and she has a huge challenge which is to be in the newspaper business at this particular time says longtime family friend Barry Diller chief executive of IACInterActiveCorp and a director of the Post Co. whose share price recently slid below $600 from a 52-week high of $885.At a lunch with Post editors and reporters Microsoft chief executive Steve Ballmer confidently predicted that in 10 years there will be no newspapers no magazines that are delivered in paper form and no media consumption except via the internet. Weymouths maybe impossible mission to change that futureor at least figure out how the Post can survive in it.It was probably not an omen but shortly before she was named publisher Weymouth was mugged at gunpoint on a Washington street. It was midnight and she and a female friend were leaving a dinner party at the home of a Post colleague. I always feel like Im a tough chick and nobody is going to mess with me Weymouth says. We were paying no attention to our surroundings which we should have been. This guy comes around the corner and says Your purses. Then he pulled out a gun and we realized he wasnt joking. The Posts limited coverage is here More details from E&amp;P.-- Detroit Media Partnership The Detroit Free Press and the Detroit News governed by a Joint Operating Agreement announced voluntary buyouts in hopes of reducing staff by up to 7 percent or 150 positions. Free Press Publisher Dave Hunke said the move was being made in light of bad business conditions. The program which is open to those 45 and older with at least 10-years experience will offer two weeks of severance pay for every year worked. Buyouts have become a common prelude to layoffs as publishers often havent found enough volunteers. More at the Free Press.-- Default Watch Alan Mutter put together a chart showing the major publishers and their varying degrees of default likelihood based on ratings from Moodys. In worst shape is Journal Register OTCBB JRCO which has a 72 percent chance of being in default. As he notes here default can mean two different things. Either the company can be in violation of some financial convenent e.g. not maintaining a proper leverage ratio or it can be in the more severe hard default which basically means bankruptcy. 		<title><![CDATA[The March Of Mobile Phone Progress Isnt Always Smooth Or Direct]]></title>

Writing in Slate last week the telecom expert lamented the terms hes facing as an aspiring iPhone 2 owner a two-year AT&amp;#038T contract thanks to the handsets newfound inability to be unlocked and a move toward a more conventional subsidized handset model.  Wu sees this as emblematic of a shift in the mobile industryThe fact that someone like me is switching to AT&amp;#038T is a sign of the times in the telephone world. The wireless industry was once and is still sometimes called a poster child for competition. That kind of talk needs to end.Hes right -- but then that kind of talk shouldnt have been started in the first place.  The mobile market was defined by long contracts locked handsets and a lack of prepaid options long before Apple arrived on the scene.  Now it appears that itll remain that way long after Apple.Admittedly this is a disappointment.  Many looked at Apples choice of a second-rate carrier -- one they could bully around -- as a sign that everything was about to change.  Finally a handset manufacturer had arisen that was powerful enough to break the industrys self-serving revenue model and empower consumers!  With the recent declaration of the iPhone 2s retreat toward conventional industry shadiness those counting on Apples benevolent technological dictatorship have found themselves disappointed as they have before and no doubt will again.  They were fooling themselves anyway did anyone really think Apple was going to tolerate phone unlocking forever?But the outlook isnt all grim.  As Wu notes the Google-led Open Handset Alliance is trying to follow in Apples footsteps with its own game-changing must-have handsets -- only this time there seems to be a more expressly ideological slant to the effort.  And Verizons Open Development Initiative while less than perfect is perhaps even more encouraging in that it shows the industry has begun to acknowledge the markets need for more flexibility in data services.And thats the real reason for hope the march of progress.  Anyone who tries to paint the mobile industry as the picture of efficient market competition is either in denial or deeply dishonest.  But wireless services will inevitably become more important and more available whether thanks to WiMAX revived municipal wifi projects now without capital costs thanks to the magic of bankruptcy! spectrum freed by digital broadcasting or some other wireless technology.  The mobile carriers havent been great at competing amongst themselves but you can bet theyll begin responding once consumers have reasonable alternatives.
